| Abstrak | : | This research was conducted at Bank BRI Syariah branch of Yogyakarta which is located at Jl. Yos Sudarso No. 1 Yogyakarta. The aim of this research was to determine the implementation of the ?akad istisna? in KPR iB product at the BRI Syari?ah Branch of Yogyakarta by using descriptive qualitative approach. The data used in this research is the primary data and secondary data. Primary data was obtained through a list of interview questions asked or obtained from the resource persons who are competent in their field, they are the people in the position of KPR iB Marketing at the Bank BRI Syariah iB and the funding officer. While the secondary data was got through the internet, books, agendas, internet and scientific papers that have relevance to support in analysising in this research. The analysis model of the data used in this research was descriptive analysis. By descriptive analysis, this study described about the information in accordance with the variables studied. And in this case, researcher described the operational mechanism of ?akad istisna? in KPR iB product at the BRI Syari?ah Branch of Yogyakarta. The results of this study show that: Generally implementation of contract istisna 'in the product in KPR iB product at the BRI Syari?ah Branch of Yogyakarta in conformity with Economic perspective of Islamic law in terms of: the concept of covenant istisna 'which is applied in the BRI Syariah, procedures and requirements for customers, by applying the 5C analysis principles, they are Capital, Capicity, Collateral, and Conditions of Economy as references in the filing procedures for customer financing. And also by applying the 4P managements which are include planning, organizing, implementing and supervising as references in the implementation in transactional activity. But there are certain aspects in the Implementation of istisna? contract in the financing KPR iB at the BRI Syari?ah Branch of Yogyakarta that researchers think is not in accordance with the perspective of Islamic law Economic found in: lack of presence of the right of customers who feel khiyar to order goods not in accordance with the wishes, sermons with reference to the Fatwa DSN-MUI No. 06/DSN-MUI/IV/2000 about istisna ', which states that"In the event of disability or goods not in accordance with the agreement, the buyer has the right khiyar (voting rights) to continue or cancel the contract" And the existence of contract charging a whole in charge to the customer, this was incompatible with the principle of justice, because basically the cost of the contract shall be borne by all parties who do not contract the whole client, this is dzalim activity that is inconsistent with the equity principle.
